Datenschutzerklärung

Über die datenschutzrechtlich relevanten Aspekte bei der Umfrage möchten wir Sie wie folgt informieren:

 

1. Allgemeiner Teil, Verantwortlicher

  • Die datenschutzrechtlich Verantwortliche ist die Medical Innovations Incubator GmbH (Vor dem Kreuzberg 17, 72070 Tübingen, Deutschland, Telefon: +49 152 / 52 99 8535, E-Mail: info@mi-incubator.com) (im Folgenden „MII“, „wir“ oder „uns“).
  • Es besteht ein Beschwerderecht bei einer Datenschutz-Aufsichtsbehörde. Sie haben dabei gegebenenfalls die Wahl unter mehreren Datenschutz-Aufsichtsbehörden. Die jedenfalls für unseren Sitz zuständige Datenschutz-Aufsichtsbehörde ist „Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg“.
  • Soweit in den folgenden Abschnitten nicht anders oder ergänzend dargestellt, gilt das Folgende:
    • Es besteht ein Recht auf Auskunft (Art. 15 EU-Datenschutz-Grundverordnung (DSGVO)) sowie auf Berichtigung (Art. 16 DSGVO) oder Löschung (Art. 17 DSGVO) oder Einschränkung der Verarbeitung (Art. 18 DSGVO). Im Falle einer Einwilligung oder falls eine Datenverarbeitung zur Erfüllung des Vertrags erfolgt, haben Sie ferner ein Recht auf Datenübertragbarkeit (Art. 20 DSGVO).

Verarbeiten wir Sie betreffende personenbezogene Daten aufgrund von berechtigten Interessen (Art. 6 Abs. 1 lit. f DSGVO), haben Sie das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung Widerspruch einzulegen (Art. 21 DSGVO); dies gilt auch für ein auf diese Bestimmungen gestütztes Profiling. Ein Widerspruch kann im Zweifel auch unter den oben genannten Kontaktdaten erfolgen.

  • Wenn Sie eine Einwilligung erteilen, besteht das Recht, die Einwilligung jederzeit zu widerrufen, ohne dass die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung berührt wird.
  • Wir löschen die verarbeiten personenbezogenen Daten unverzüglich nach der Beendigung der Verarbeitung, soweit nachfolgend nicht anders angegeben. Falls Sie zuvor die Löschung begehren, werden die Daten unverzüglich gelöscht, soweit keine andere Rechtsgrundlage für die Verarbeitung besteht.
  • Die Bereitstellung der personenbezogenen Daten durch Sie ist, soweit nachstehend nicht anders angegeben, weder gesetzlich noch vertraglich vorgeschrieben oder für einen Vertragsabschluss erforderlich. Sie und die betroffene Person sind nicht verpflichtet, die Daten bereitzustellen. Mögliche Folge, wenn Sie die Daten nicht bereitstellen, ist, dass Sie die Leistungen aus der jeweiligen Datenverarbeitungen nicht oder nicht vollumfänglich in Anspruch nehmen können und eine Alternative wählen müssen.
  • Es besteht keine automatisierte Entscheidungsfindung und kein Profiling im Sinne von Art. 22 DSGVO.

 

2. Umfrage über Google Forms

  • Für die Durchführung der Umfrage setzen wir Google Forms im Rahmen von Google Workspace (ehemals „G Suite“) ein. „Google Forms“ wird von Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Irland (in diesem Abschnitt als „Google“ bezeichnet) angeboten.
  • Die Verarbeitung erfolgt zu dem Zweck, Ihnen ein praxistaugliches Umfrageformular anbieten zu können. Die Rechtsgrundlage für die Verarbeitung der Daten ist die Auftragsverarbeitungsvereinbarung, die im Rahmen von Google Workspace besteht, sowie die Verarbeitung zur Wahrung berechtigter Interessen gem. Art. 6 Abs. 1 lit. f DSGVO.
  • Bei der Datenverarbeitung kann es auch zu Übermittlungen an die Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, kommen. Personenbezogene Daten können also an ein Drittland, nämlich die USA, gesendet werden. Ein sog. Angemessenheitsbeschluss der EU-Kommission für die USA fehlt. Dies bedeutet, dass in den USA ein Datenschutzniveau besteht, das hinter dem Schutzniveau in der Europäischen Union zurückbleibt und daher ein Risiko für Ihre personenbezogenen Daten besteht, z. B. aufgrund behördlicher Zugriffsmöglichkeiten. Die Angemessenheit des Datentransfers bei Datenübermittlungen zu Google, soweit dabei ein Datentransfer in die USA verbunden sein sollte, wird daher durch die von uns vereinbarten EU-Standarddatenschutzklauseln gewährleistet.

  • Falls Sie die Einbindung von Google Forms nicht wünschen, nehmen Sie bitte nicht an der Umfrage per Google Forms teil. Sie können uns gerne über eine der sonstigen Möglichkeiten für eine Rückmeldung geben, z. B. per E-Mail, Telefon oder ein Briefpostschreiben.
  • Wir löschen die Daten unmittelbar nach Abschluss der Umfrage und bewahren lediglich eine statistische Auswertung über alle Umfragerückmeldungen hinweg. Ausgenommen hiervon ist die E-Mail-Adresse, wenn Sie eine solche mitgeteilt haben (siehe hierzu den Abschnitt unten).

 

3. Angabe einer E-Mail

Zweck: Im Rahmen der Umfrage haben Sie die Möglichkeit, eine E-Mail-Adresse anzugeben. Wenn Sie ferner in der Umfrage Ihre Einwilligung erteilen, möchten wir Sie ggf. gerne zu Werbezwecken kontaktieren, z. B. durch ein individuelles E-Mail an Sie, die Aufnahme in unseren regelmäßigen E-Mail-Newsletter oder durch die Zusendung weiterer Umfragen. Wir bittet daher im Umfrageformular um Ihre Einwilligung. Hierzu informieren wir Sie wie folgt:

Freiwilligkeit und Widerruf: Die Erteilung der Einwilligungen ist vollkommen freiwillig. Sie haben das Recht, jede Ihrer Einwilligungen jederzeit zu widerrufen. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung nicht berührt. Einen Widerruf können Sie z. B. per E-Mail an info@mi-incubator.com erklären.

Betroffene Daten: Ihre E-Mail-Adresse

Inhalt der Einwilligung, um die Sie direkt bei dem Anmeldeformular gebeten werden:

  • Sie willigen ein, dass wir mit Ihnen per E-Mail zu dem oben genannten Zweck Kontakt aufnehmen und Ihnen E-Mails mit werblichem Inhalt, wie oben beschrieben, zusenden.
  • Sie willigen ein, dass wir Ihre Daten zu den oben genannten Zwecken speichern, insbesondere in eine Newsletter-Verteilerliste aufnehmen und zur regelmäßigen Zusendung des Newsletters nutzen.

Ergänzende Informationen zum Datenschutz anlässlich der Datenerhebung:

  • Die Verarbeitung erfolgt für die oben unter „Zweck“ angegebenen Zwecke. Die Rechtsgrundlage für die Verarbeitung der Daten ist Ihre Einwilligung gem. Art. 6 Abs. 1 lit. a DSGVO. Die Rechtsgrundlage für die Verarbeitung der Daten ergibt sich zudem aus der Durchführung vorvertraglicher Maßnahmen gem. Art. 6 Abs. 1 lit. b DSGVO und aus der Wahrung berechtigter Interessen gem. Art. 6 Abs. 1 lit. f DSGVO.
  • Das genannte berechtigte Interessen gem. Art. 6 Abs. 1 lit. f DSGVO besteht darin, dass technisch zwingend Dritte in Übermittlungen per E-Mail (die Internetserverbetreiber auf dem Kommunikationsweg und die Anbieter der E-Mail-Postfächer) eingeschaltet werden müssen. Ohne eine Einbindung der Dritten ist die Kontaktaufnahme mit Ihnen nicht möglich. Die Einbindung der Dritten beschränkt sich auf die unmittelbar am Kommunikationsvorgang Beteiligten. Zudem besteht das berechtigte Interesse darin, Ihnen die von Ihnen angefragten werblichen Informationen zukommen zu lassen.
  • Wir löschen die Daten unverzüglich nach dem Abschluss des Kontakts mit Ihnen, z. B. wenn Sie den Newsletter abbestellen. Falls Sie zuvor widerrufen, werden die Daten unverzüglich gelöscht, soweit keine andere Rechtsgrundlage für die Verarbeitung besteht.
  • Es besteht ein Recht auf Auskunft (Art. 15 DSGVO) sowie auf Berichtigung (Art. 16 DSGVO) oder Löschung (Art. 17 DSGVO) oder Einschränkung der Verarbeitung (Art. 18 DSGVO) oder ein Recht auf Widerspruch gegen die Verarbeitung (Art. 21 DSGVO) und ferner ein Recht auf Datenübertragbarkeit (Art. 20 DSGVO). Die betroffene Person hat das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung sie betreffender personenbezogener Daten, die aufgrund von berechtigten Interessen (Art. 6 Abs. 1 lit. f DSGVO) von uns verarbeitet werden, Widerspruch einzulegen; dies gilt auch für ein auf diese Bestimmungen gestütztes Profiling. Zudem hat die betroffene Person das Recht, jederzeit Widerspruch gegen die Verarbeitung sie betreffender Daten zum Zwecke der Direktwerbung einzulegen; dies gilt auch für ein Profiling, soweit es mit solcher Direktwerbung in Verbindung steht.
  • Es besteht das Recht, die Einwilligung jederzeit zu widerrufen, ohne dass die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung berührt wird.
  • Die Bereitstellung der personenbezogenen Daten durch Sie ist weder gesetzlich noch vertraglich vorgeschrieben oder für einen Vertragsabschluss erforderlich. Sie und die betroffene Person sind nicht verpflichtet, die Daten bereitzustellen. Mögliche Folgen, wenn Sie die Daten nicht bereitstellen, ist, dass wir Ihnen keine E-Mails zusenden können.

We would like to inform you about the aspects of the survey relevant to data protection law as follows:

1. general part, responsible person

  • There is a right of appeal to a data protection supervisory authority. You may have the choice between several data protection supervisory authorities. The data protection supervisory authority responsible for our headquarters is „The State Commissioner for Data Protection and Freedom of Information Baden-Württemberg“.
  • Unless otherwise stated or supplemented in the following sections, the following shall apply:
    • There is a right to information (Art. 15 EU General Data Protection Regulation (GDPR)) as well as to correction (Art. 16 GDPR) or deletion (Art. 17 GDPR) or restriction of processing (Art. 18 GDPR). If we process personal data relating to you on the basis of legitimate interests (Art. 6 (1) f DSGVO), you have the right to object to the processing at any time on grounds relating to your particular situation (Art. 21 DSGVO); this also applies to profiling based on these provisions. In case of doubt, an objection can also be made using the above contact details.If you give your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until the withdrawal.

You and the data subject are not obliged to provide the data. 2. Survey via Google Forms

  • To conduct the survey, we use Google Forms as part of Google Workspace (formerly „G Suite“). „Google Forms“ is offered by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (referred to as „Google“ in this section).
  • The processing is carried out for the purpose of being able to offer you a practical survey form. The legal basis for the processing of the data is the order processing agreement that exists in the context of Google Workspace, as well as the processing for the protection of legitimate interests pursuant to Art. 6 (1) lit. f DSGVO.
  • Data processing may also involve transfers to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Personal data may therefore be sent to a third country, namely the USA. A so-called adequacy decision of the EU Commission for the USA is missing. This means that there is a level of data protection in the USA that falls short of the level of protection in the European Union and that there is therefore a risk to your personal data, e.g. due to access by authorities. The appropriateness of the data transfer in the case of data transfers to Google, insofar as this should involve a data transfer to the USA, is therefore guaranteed by the EU standard data protection clauses agreed by us.

  • If you do not want Google Forms to be included, please do not participate in the survey via Google Forms. You are welcome to give us feedback via one of the other options, such as email, phone, or a letter post.
  • We delete the data immediately after the survey is completed and only keep a statistical analysis across all survey responses. The exception to this is the e-mail address if you have provided one (see the section below).

 

3. Indication of an e-mail

 Purpose: As part of the survey, you have the option to provide an email address. Furthermore, if you give your consent in the survey, we may wish to contact you for promotional purposes, such as sending you an individual email, including you in our regular email newsletter, or sending you further surveys. We therefore ask for your consent in the survey form. For this purpose, we inform you as follows:

Voluntariness and revocation: The granting of consents is completely voluntary. You have the right to revoke any of your consents at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation. You can declare a revocation, for example, by e-mail to info@mi-incubator.com.

Data concerned: Your e-mail address

Content of the consent you are asked for directly on the registration form:

  • You consent to us contacting you by email for the above purpose and sending you emails with promotional content as described above.
  • You consent to us storing your data for the above-mentioned purposes, in particular including it in a newsletter distribution list and using it to send you the newsletter on a regular basis.

Supplementary information on data protection on the occasion of data collection:

  • The processing is carried out for the purposes stated above under „Purpose“. The legal basis for the processing of the data is your consent pursuant to Art. 6 para. 1 lit. a DSGVO. The legal basis for the processing of the data also results from the implementation of pre-contractual measures pursuant to Art. 6 para. 1 lit. b DSGVO and from the protection of legitimate interests pursuant to Art. 6 para. 1 lit. f DSGVO.
  • The aforementioned legitimate interest pursuant to Art. 6 (1) lit. f DSGVO consists in the fact that it is technically mandatory to involve third parties in transmissions by e-mail (the internet server operators on the communication path and the providers of the e-mail inboxes). Without the involvement of third parties, it is not possible to contact you. The involvement of the third parties is limited to those directly involved in the communication process. In addition, the legitimate interest is to send you the promotional information you have requested.
  • We delete the data immediately after the conclusion of the contact with you, e.g. if you unsubscribe from the newsletter. If you revoke beforehand, the data will be deleted immediately, unless there is another legal basis for the processing.
  • There is a right to information (Art. 15 GDPR) as well as to rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR) or restriction of processing (Art. 18 GDPR) or a right to object to processing (Art. 21 GDPR) and furthermore a right to data portability (Art. 20 GDPR). The data subject has the right, on grounds relating to his or her particular situation, to object at any time to processing of personal data concerning him or her which is processed by us on the basis of legitimate interests (Art. 6(1)(f) DSGVO); this also applies to profiling based on these provisions. In addition, the data subject shall have the right to object at any time to processing of personal data concerning him or her for the purposes of direct marketing; this shall also apply to profiling insofar as it is related to such direct marketing.
  • There is the right to revoke the consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until the revocation.
